****UPDATE****** Wayne Circuit Judge Cynthia Gray Hathaway rules that the emotional outburst of Aiyana Jones’s grandmother Mertilla Jones will not be enough to declare a mistrial, however the judge did advise, if one more emotional outburst happens, from ANY witnesses, the trial cannot go on.

Jurors in the trial against Joseph Weekly were questions Monday morning after an outburst by Ayiana Jones’s grandmother last Wednesday.
Joseph Weekley is charged with involuntary manslaughter in the death of Aiyana Stanley-Jones. His first trial in June ended without a verdict. His gun went off after he stormed a Detroit home to catch a murder suspect in 2010.
Last Wednesday Mertilla Jones broke down into an emotional outburst as she described the shooting of 7-year-old Aiyana Stanley-Jones. Jones looked at Officer Joseph Weekley in court and said, “You killed my grandbaby.”

The outburst continued until the judge asked for her to leave the stand. She was escorted out of the courtroom as she continued to shout at Weekley.
Due to that outburst on defense attorneys for Weekly have submitted a motion for a mistrial to the judge, prosecution has also submitted to counter that motion. Monday morning jurors were questioned how the emotional outburst of Jones’s grandmother affected them.
