Jussie Smollett’s attempt to appeal his conviction for faking a hate crime in 2019 has failed.
On Friday (December 1), an Illinois appeals court upheld Smollett’s disorderly conduct conviction, with a three-judge panel voting 2-1, according to documents obtained by TMZ.
Smollett will likely return to a Chicago jail to complete his sentence of 150 days. Lawyers could also again appeal the decision to the Illinois Supreme Court.
The news comes after a jury found Smollett guilty in December 2021 of six felony counts of disorderly misconduct for giving false information to the police after he staged a hate crime in Chicago.
In January 2019, Smollett paid brothers Abel and Ola Osundairo to wear ski masks, yell racist and homophobic slurs, and wrap a rope around his neck while pouring bleach on him.
Smollett was sentenced to 30 months of felony probation of which he was supposed to spend the first 150 days in county jail. He was released after six days pending his appeal.
The actor has maintained his innocence throughout the entire ordeal.
