State Sen. Virgil Smith (D-Detroit) was taken into police custody, but not officially charged in connection with a Sunday morning shooting that happened at his residence in Detroit.After an interview with police Sunday afternoon Smith was arrested and held at the station pending formal charges.The Wayne County Prosecutor’s Office denied an initial request for charges Monday afternoon, instead returning the case to the Detroit Police Department for further investigation.Detroit Police Chief James Craig said the shooting happened around 1 a.m. on Mother’s Day.Craig told the Detroit News that the department has handled the case like they would any other.
Smith, 35, allegedly fired multiple shotgun shells at his girlfriend, who is also his ex wife. None of the shots hit her.
Craig said that 10 shots struck the woman’s 2015 Mercedes-Benz.
Smith represents parts of Detroit, and Lincoln Park, Southgate and Allen Park. He formerly represented parts of Dearborn before the district was redrawn, and also during three terms as a State Representative.
According to reports Detroit police used a warrant to search Smith’s house Sunday afternoon. Officers were seen leaving with a large black bag covering whatever items they removed from the house.
If charges are filed Smith will likely have to have his case moved to a different court. His father, Virgil C. Smith is the former chief judge for the 3rd District Court, which oversees criminal cases in Wayne County.
